1. Information on how to enter and the prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.  

2. Entry is only open to residents of Australia and New Zealand aged 18 years or over (unless otherwise specified). Employees (and immediate families) of the Promoter, Are Direct (AUS & NZ), and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or stepchild (whether natural or by adoption), parent, stepparent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, stepbrother, stepsister or first cousin.

3. The promotion commences on Thu, 22 Jun 2023 and closes on Thu, 01 Feb 2024 at 23:59pm AEST (for online entries) or last mail received (for mail entries) at 17:00pm AEST on the same day (“Promotional Period”).

4. The Promoter’s decision is final and no correspondence will be entered into.

5. To be eligible to enter, individuals must purchase any Puzzler branded puzzle magazine that features the ‘Trip to Paradise’ promotional logo (“Participating Titles”) during the Promotional Period. For the sake of clarity, any Puzzler branded puzzle magazine that does not feature the ‘Trip to Paradise’ promotional logo will be deemed invalid for entry into this promotion.

6. To enter, individuals must then complete one (1) of the following entry methods during the Promotional Period:

a) Mail Entry: To enter via mail, individuals must, complete the “Prize Puzzle” in the Participating Title (purchased in accordance with clause 5 above), write the correct solution to that puzzle (“Prize Answer”) in the space provided on the official entry coupon (found within that Participating Title), complete the rest of the official coupon with all of the requested personal details (including their full name, mailing address, postcode, valid email address and daytime telephone number), and then send the fully completed entry coupon to “Puzzler Trip to Paradise, GPO Box 590, Sydney, NSW 2001, AU” (for Australian residents) or to  “Puzzler Trip to Paradise, Private Bag 92-217, Auckland Mail Centre, Auckland, NZ”  (for New Zealand residents) so that it is received during the Promotional Period;

OR

b) Online Entry: To enter online, individuals must complete the puzzle found on the entry coupon in the Participating Title (purchased in accordance with clause 5 above) then visit the promotional entry page at www.puzzler.com.au/competitions (in Australia) or www.puzzler.co.nz/competitions in (New Zealand), write the correct answer of the puzzle completed as prompted, and submit the online form with their personal details fully completed (including their full name, address, valid email address and daytime telephone number) so that it is received during the Promotional Period.

7. Maximum of two (2) entries are permitted per Participating Title/Issue purchased, subject to the following: (a) maximum of one (1) Online Entry permitted per Participating Title/Issue purchased; (b) maximum of one (1) Mail Entry permitted per Participating Title/Issue purchased; and (c) each entry must be submitted separately and in accordance with the entry instructions outlined above. Each mail entry must be posted in a separate stamped envelope and contain an official entry form with a correct Participating Title/Issue puzzle solution. For the sake of clarity, individuals are eligible to submit up to two (2) entries for each Participating Title/Issue purchased, however one (1) of those entries must be an Online Entry and the other must be a Mail Entry. 

8. Entrants must retain their original purchase receipt(s) for all entries as proof of purchase. Failure to produce the proof of purchase for all entries when requested may, in the absolute discretion of the Promoter, result in invalidation of ALL of an entrant’s entries and forfeiture of any right to a prize. Purchase receipt(s) must clearly specify the store of purchase and that the purchase was made during the Promotional Period but prior to entry.

9. The Promoter is neither responsible nor liable for late, lost or misdirected entries, or entries not received by the Promoter for any reason whatsoever. Original copies of entries will not be returned to the entrant after the draw has been completed.

10. Incomplete, indecipherable, incorrect or illegible entries will be deemed invalid.

11. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.

12. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.

13. The draw will take place on Thu, 08 Feb 2024 at Direct Response Australia, Unit A 31-33 Sirius Road, Lane Cove West, NSW 2066 at 10:00am (AEST). The Promoter may draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn. The winners will be notified in writing within two (2) business days of the draw and by telephone. The winners’ names will be published online at www.puzzler.com.au and www.puzzler.co.nz and in The Advertiser (in the event a winner is from SA) from Thu, 15 Feb 2024. 

14. The first (1) valid and correct entry drawn from all entries received will win an AU$12,000 travel voucher to be used at Travella Travel towards any trip of the winners choice. The second (1) valid and correct entry drawn from all entries received will win an AU$6,000.00 travel voucher to be used at Travella Travel towards any trip of the winners choice. The third (1) valid and correct entry drawn from all entries received will win an AU$2,000.00 travel voucher to be used at Travella Travel towards any trip of the winners choice.

Total prize pool is valued at AU$20,000 incl. GST. 

15. If necessary, an unclaimed prize draw may be held on Thu, 09 May 2024 at the same time and place as the original draw in order to distribute any unclaimed prizes, subject to any directions from a regulatory authority.  Winners, if any, will be notified by telephone and in writing within two (2) business days of the unclaimed prize draw. The winners’ names will be published online at www.puzzler.com.au and www.puzzler.co.nz and in The Advertiser (in the event a winner is from SA) from Thu, 16 May 2024. 

16. Prizes must be taken as offered. The prizes, or any unused portion of a prize, are not transferable to another person or exchangeable for cash. Prize winners are advised that tax implications may arise from their prize winnings and they should seek independent financial advice prior to acceptance of their prize. All prizes must be taken as offered, and are subject to individual store terms and conditions of use.

17. Each prize must be booked in full by Thu, 08 August 2024. Redemption of a prize is subject to booking and flight availability at time of booking. Frequent flyer points will not form part of a prize. Standard conditions for tickets and accommodation apply. Prizes are subject to the standard terms and conditions of individual prize and service providers. The winners may be required to present their credit card at time of accommodation check in.

18. Each winner (and their companion/s) are responsible for all other expenses associated with taking the prize, including transport to and from departure/return point (including but not limited to additional domestic airfares if required), any additional accommodation, medical expenses, room upgrades, in-room charges, taxes (excluding airline and airport taxes), additional spending money, meals, drinks, transfers (unless specified), laundry charges, activities (unless specified), incidentals, energy surcharges, gratuities, service charges, passports, visas, vaccination, travel insurance, items of a personal nature and all other ancillary costs. Travel insurance is highly recommended to protect against the additional costs incurred in the event of unforeseen circumstances (which is not mandatory). These costs and expenses are the responsibility of the winner. Any extension to the duration of the prize is at the winner's sole expense and subject to availability at the time of booking. For the removal of doubt, taxes for international travel are included in the prize winning. International airfares provided by the Promoter.

19. A valid passport is required for all international journeys. All passports must be valid for six (6) months prior to departure. It is the responsibility of the winner and their travel companion to ensure they have all required travel documentation (including but not limited to passports & visas) as required for travel to the destination point. All costs associated with obtaining this travel documentation is the responsibility of the winner. 

20. In the event of war, terrorism, state of emergency or disaster, the Promoter reserves the right to cancel, terminate, modify or suspend the promotion or suspend or modify a prize, subject to any written directions from a relevant regulatory authority.

21. The prizes will be delivered to the nominated mailing address of each prize winner to any State/Territory and/or city/suburb in Australia or New Zealand. 

22. The Promoter is neither responsible nor liable for any late lost or misdirected mail (including but not limited to prizes). 

23. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia or any statutory consumer guarantees as provided under consumer protection laws in New Zealand (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.

24. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) taking/use of a prize. 

25. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate. 

26. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.

27. Any cost associated with accessing the promotional website or posting any entries via mail is the entrant’s responsibility and is dependent on the Internet service provider, mailing company used and postage option selected. 

Privacy: 

28. The Promoter collects personal information ("PI") in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. The Promoter may also disclose PI to other third parties, who may send the entrant promotional and marketing communications, unless the entrant ticks the box on the entry form stating "Please do not provide information about me to any organisation not associated with this competition". Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be accessed by visiting www.puzzler.com.au/legals/privacy-policy (for Australian residents) or www.puzzler.co.nz/legals/privacy-policy (for New Zealand residents). In addition to any use that may be outlined in the Promoter's Privacy Policy, the Promoter may also, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to opt out, access, update or correct PI to the Promoter and direct any complaints regarding treatment of their PI according to the Privacy Policy. All entries become the property of the Promoter. Entries collected in Australia or New Zealand will not be disclosed overseas.
